In an ideal world, tenancies would naturally come to an end and the landlord and tenant would part ways amicably. As we know, this unfortunately isn’t always the case.

Since the recent introduction of the Renter’s Rights Bill, it is imperative that you follow the correct procedures to evict your tenant, or face serious consequences which could mean that you are unable to take back possession of your property or worse still, you could actually face criminal proceedings.

Tenancy Deposit Scheme Disputes

Your landlord is required by law to place your deposit into an authorised tenancy deposit protection scheme and to provide you with details of the scheme within 30 days of receiving it from you.

This legal requirement is designed to stop landlords from spending or otherwise dissipating your deposit and to ensure that it is readily available to you at the end of your tenancy.

The three government-approved schemes are:

  1. Tenancy Deposit Scheme (TDS)

  2. Deposit Protection Scheme (DPS)

  3. My Deposits

Compensation claim

Unfortunately, some landlords ignore their legal obligations, either by not providing you with the aforementioned documents, not protecting your deposit at all or protecting it too late i.e. after the 30-day deadline.

If your landlord fails to comply with the deposit protection rules, you may be entitled to compensation.  Our specialist property team have extensive experience with these claims.

Illegal Eviction

If your landlord has evicted you or is threatening to evict you without a lawful reason, it’s likely you are feeling stressed and aren’t quite sure what your options are. In the event that your landlord hasn’t followed a formal eviction procedure or doesn’t have fair grounds on which to evict you, you should seek advice from our expert property team as soon as possible.

We can advise you if you are facing eviction but have not yet left the property, and may be able to help you stay in your home if your case is strong enough; if you have already been evicted and want to make a claim for compensation or attempt to return to the property, we can also help you to understand the options open to you and your likelihood of success.
